DAILY PROGRESS, Charlottesville, Virginia, Friday, December 27, 1985 Local And State Briefs Jail Gets Aid Dealing With Inmates Albemarle County police and state' troopers were called to the Albemarle-Charlottesville Joint Security Complex Thursday evening in a show of force to help jail guards deal with five inmates who had refused to return to a cellblock, police and jail officials said today. Jail Lt. David Wallace described the 7 p.m. incident as but said the jail's holiday work schedule made it necessary to call for outside assistance. "Normally, in situations like this we call in people from other posts inside the complex," Wallace said.

"The only reason we called in police this time was because we were understaffed because of the Albemarle Cmdr. Tom Maxwell and two other county police officers were sent to the jail as were three state police troopers, Cmdr. Terry W. Hawkins said today. The inmates "were told to get back in the cell, or the officers would put them back in," Hawkins said.

"They decided to go back in on their $4,200 In Stereo, TV Equipment Stolen A University of Virginia student returned from a Christmas vacation late Thursday morning to find that someone had broken into his home and stolen more than $4,200 of television and stereo equipment, Charlottesville police said today. Lt. Clyde Snoddy said a thief or thieves apparently entered the residence in the 1200 block of Wertland Street by breaking a sliding glass door. The student reported that a color television, video recorder, cassette deck, turntable, remote control device, stereo tuner and amplifier, speakers, watch and camera were missing, Snoddy said. Ex-Nelson Administrator Has New Job FINCASTLE (AP) John Williamson III, an employee in the financial division of the Chesapeake Potomac Telephone Co.

in Charleston, W.Va., and a former Nelson County administrator, is the new administrator of Botetourt County. Williamson, a Bedford County native, was the unanimous selection of the board of supervisors at a special meeting this week. A graduate of Liberty High School and Virginia Commonwealth University, Williamson, 31, served as assistant administrator of Bedford County and administrator of Nelson County before interrupting his working career to return to school. He earned a master's degree in business administration at the College of William Mary before joining The salary of the new administrator will be $50,000 a $6,500 increase over that of William Manion of Buchanan, who resigned the post in August. Manion became director of Botetourt's Public Service Authority.

There were 88 applicants for the administrator's position. Jail Escapee Found Hiding In Closet NORFOLK (AP) A teenager accused of capital murder in Virginia Beach was recaptured Thursday after escaping from the Norfolk jail by jumping out of a second-story window, police said. Darryl Eugene Foster, 19, was found hiding in a bedroom closet in a raid at a house about 10:15 a.m., said Lt. Curtis M. Todd Jr.

An anonymous telephone tip led to the raid, Todd said. Foster had been at large since 10:05 p.m. Tuesday, when he jumped from a window in the police burglary squad office after an officer allowed him to make a telephone call to his girlfriend. The 16-year-old girlfriend, who also had been charged with murder and was free on bond, was in the room where Foster was captured, Todd said. Todd said the girl was being questioned about Foster's escape.

Foster and the girl had been arrested Nov. 12 and charged in the Oct. 13 robbery and slaying of Robert R. Uhlar, 33, of Virginia Beach. Uhlar's body was found near a dumpster.

Todd said Foster escaped after making the telephone call by running to an open window and jumping about 10 feet to a ledge. He then jumped another 12 feet to the ground, Todd said. "The investigator was allowing him to make a personal call because Foster was cooperating with us," Todd said. Foster was in the Norfolk jail after being charged with several burglaries in that city, Todd said. Developer Has $21 Million In Debts ROANOKE (AP) David Wilson, the largest developer of property around Smith Mountain Lake, has debts of $21.5 million, according to documents filed in U.S.

Bankruptcy Court. Wilson, whose property holdings were listed with the court as being worth $15.7 million, is seeking legal protection from more than 300 creditors while he reorganizes his land development business. Wilson's projects have been marred by a financial crisis since July, when he abruptly halted operations at Bernard's Landing, Striper's Landing and Vista Pointe. Facing a cash shortage triggered by slow condominium sales, Wilson laid off most of his employees, canceled condominium rental reservations and cut back his sales operations. Wilson owes more than $200,000 in federal and state taxes, the court papers show.

The debt includes $13.4 million in property-secured loans and $7.9 million in unsecured loans. Wilson's major lenders have sought to take over more than 100 unsold condominiums that were listed as security for large loans. The 12- page listing of Wilson's creditors includes contractors, security firms, banks, newspapers and insurance companies. Annexation Case Generates Testimony RICHMOND (AP) The three-way annexation struggle involving Petersburg, Hopewell and Prince George County has generated more written testimony than any case that the Virginia Commission on Local Government has considered in its six-year history, says the commission's assistant director. G.E.

McCormack Jr. said the commission will issue its recommendations in March or April on the hotly disputed annexation, which involves approximately 35 square miles of the county. Petersburg wants to annex: a crescent-shaped parcel of 23.36 square miles, including Fort Lee and the Federal Correctional Institution. Petersburg's size would more than double if it gets the entire territory. Hopewell is seeking 16.6 square miles, including about five square miles that Petersburg wants.

The commission's recommendation will be sent to a panel of three judges who will decide the issue. Shellfish Harvesting Ban Remains RICHMOND (AP) Shellfish harvesting in the James River and lower Chesapeake Bay is expected to remain closed for the rest of the year, state health officials say. W. Wiley, director of the state Health Department's bureau of Cloyde shellfish sanitation, said the closed areas will be reopened as soon as officials take two consecutive water samples that are satisfactory. Seven samplings have been conducted since harvesting areas were closed after the floods of Nov.

Reed, said he will file suit in U.S. District Court in Alexandria.

He contends his constitutional rights have been violated by a state law that requires defaced absentee ballots to be thrown out, even though the voter's intent is clear. He also said the rights of the person who attempted to vote for him were being violated because the defaced ballot was not counted. Death Notices WILLIAM H. EVANS William Henry "Billy" Evans, 73. of Rt.

1, Lovingston died, Thursday morning, Dec. 26, 1985, at his residence. Born July 15, 1912, in Nelson County he was the son of the late Charles Henry Evans and Annie Bridgewater Evans. He was a World War II Army Veteran and a recipricant of the Purple Heart Medal while serving with the 35th Infantry in Northern France. He was a member of Oak Hill Baptist Church and a retired employee of the Waynesboro General Electric.

He is survived by his wife, Josephine Lincoln Evans; one daughter, Mrs. Betty E. Hoffer, of Richmond; one son, Charles William Evans, of Richmond; one sister Mrs. Elizabeth E. Wright of Lovingston; three grandchildren, Matthew Grant Evans, Michael Emil Hoffer and Meaghan Elizabeth Hoffer all of Richmond.

5 election by one vote if a three panel had not discarded a ballot during a Dec. 4 re-count. The judges ruled the ballot was defaced because an was marked in boxes for both candidates and the word "mistake" was written beneath Mrs. Reed's name. The judges also allowed Mrs.

Reed an additional absentee vote, which left the candidates with 1,184 votes apiece. The election was settled when Mrs. Reed's name was drawn by officials on Dec. 5. fa*gan's decision to take the matter to federal court follows a Christmas Eve ruling by the recount judges that they would not grant fa*gan another hearing on the defaced ballot.

25, 1985. Born, Oct. 13, 1958, in a Charlottesville Hospital, she was the when the voter's intent was clear, fa*gan's attorney James E. Jarrell Jr. argued that the ballot should be counted.

After the hearing, Judge John A. Jamison said that Virginia law simply does not provide for counting defaced ballots. Further consideration on the matter wouldn't serve a useful purpose, he ruled. "The judges say there hasn't been a case like this before and they don't have anything to change their ruling. Well, they have a case now, fa*gan versus Reed," fa*gan said.

Mrs. Reed's attorney, Thomas L. Bricken, said his client would not be directly involved in any case fa*gan files in federal court.
